Article 1 – Who we are
These terms apply to purchases from Physical Sports Group B.V., trading as PH Fitness, Noorderpoort 33, 5916 PJ Venlo, the Netherlands, Chamber of Commerce (KvK) 99011158, VAT NL868747506B01, support@phfitness.nl.
Article 2 – Scope
These terms apply to every order placed by a consumer via phfitness.nl, phfitness.de and the other country versions of our web shop. Separate terms apply to business customers.
Article 3 – Offer and prices
All prices are in euros, including VAT and including delivery to the countries listed in our shipping policy. We are not bound by obvious mistakes or errors in the offer.
Article 4 – Conclusion of the contract
The contract is concluded as soon as you place the order with an obligation to pay. You will immediately receive a confirmation by email. If a product is unexpectedly unavailable, we will inform you as soon as possible and refund you within 14 days.
Article 5 – Payment
You pay when ordering, using one of the payment methods shown at checkout.
Article 6 – Delivery
We deliver to the countries listed in our shipping policy, Monday to Friday, to the first door. The delivery time is shown with the product and is an estimate; we deliver within 30 days at the latest, unless we agree on a later date together. If we cannot, you may cancel the contract free of charge. The risk of loss or damage passes to you as soon as you receive the product.
Article 7 – Withdrawal and returns
You have a statutory right of withdrawal of 14 days; see the Right of withdrawal page. In addition, we offer 30-day returns; see our returns policy.
Article 8 – Conformity (legal guarantee)
We guarantee that the product complies with the contract and has the properties you may expect. If it does not, you are entitled to repair or replacement and, if that fails, to a price reduction or termination of the contract. This statutory right applies in addition to our warranty (Article 9) and is not limited by it.
Article 9 – PH Fitness warranty
For home use we give a 2-year warranty on manufacturing and material defects, including on treadmills. For commercial use (for example in a gym) this is 6 months. The warranty applies to normal use in accordance with the manual. Normal wear of wear parts, cosmetic damage and damage caused by incorrect assembly, overloading, your own modifications or insufficient maintenance are not covered. You can report a claim to support@phfitness.nl with your order number and photos or a video.
Article 10 – Complaints
Report a defect or complaint within a reasonable time after you discover it; within two months is always in time. We would like to hear about visible transport damage within 48 hours, with photos; this speeds up handling but does not limit your rights. We respond within 14 days. We are not affiliated with a dispute resolution body.
Article 11 – Liability
Our liability is limited to the amount of the order. This limitation does not apply in the event of intent or deliberate recklessness, personal injury or death, or insofar as the law does not permit a limitation.
Article 12 – Safe use
Assemble and use the product in accordance with the manual and check it regularly for wear or damage. Assembly is not included.
Article 13 – Applicable law
These terms are governed by Dutch law. If you live in another country, you retain the protection of the mandatory consumer protection rules of that country. You can bring a dispute before the competent court in your place of residence.
